Actress Katherine Heigl is suing Duane Reade for $6 million over tweeting her photo without permission.
Neil Cavuto had on attorneys Heather Hansen and Randy Zelin to discuss the case.
Hansen argued that she has grounds to sue. “It’s an endorsement, not only did they do the picture…but they also said she can’t resist shopping at Duane Reade. By doing that they have implied she’s endorsed Duande Reade.”
Zelin disagreed, saying, “Facts are not protected…all the social media was doing was saying what was factually true. Miss Heigl…came out of Duane Reade with a Duane Reade shopping bag.”
Hansen countered with, “Your look is your property, your picture is your property, you have a right of publicity, so you have the right to use that the way that you want to. …Say she has a deal with CVS to do an endorsement for them, now that deal’s out the window.”
